In 2008, a black Walmart employee named Jdimytai Damour was killed by a stampede of shoppers who broke down the doors of the store in Valley Stream, New York. His death shocked the nation and raised questions about the safety and ethics of Black Friday shopping. Not only for the Walmart store, but also for the customer who trampled him.

According to reports, the shoppers who caused the stampede showed little concern for Damour’s life or the safety of others. Some of them reportedly stepped over his body, ignored the pleas of the workers to stop, and even complained about the delay in opening the store.

They were lured by the low prices that Walmart had advertised for items such as a 42-inch LCD TV, which were a hot commodity at the time. The store was closed by the police for several hours, but reopened later that day and continued to sell its merchandise.

How Did Walmart and the Authorities Respond to the Jdimytai Damour Getting Trampled?

The death of Jdimytai Damour sparked outrage and condemnation from the public, the media, and the authorities. Walmart issued a statement expressing its condolences and promising to cooperate with the investigation.

The company also announced that it would review its crowd control policies and procedures for future events. However, Walmart faced legal action from several parties who accused it of negligence and recklessness.

In 2009, the former Nassau County District Attorney Kathleen Rice filed felony reckless endangerment charges against Walmart, alleging that the company had failed to provide adequate security and crowd management for the Black Friday event.

The charges carried a maximum penalty of $10,000 and four years in prison. However, in May 2010, Walmart agreed to pay nearly $2 million to settle the case and avoid criminal prosecution.

The settlement included $400,000 to compensate Damour’s family and the injured victims, $1.5 million to fund social services and community programs in Nassau County, and $60,000 to cover the costs of the investigation.

Around the same time, the U.S. Occupational Safety and Health Administration (OSHA) concluded that Walmart had committed a “serious violation” of rules requiring employers to make sure their workers are safe from hazards.

OSHA issued a $7,000 fine and a citation to Walmart, stating that the company had exposed its employees to “the recognized hazard of being crushed by the crowd” and had failed to implement “reasonable and effective crowd management principles”. Walmart contested the fine and the citation, arguing that they were arbitrary and excessive.

The company spent nearly six years and more than $1 million in legal fees to fight the case, but eventually lost in 2016, when a federal appeals court upheld OSHA’s decision.

How Is Jdimytai Damour Remembered on Black Friday 2023

The death of Jdimytai Damour is widely regarded as one of the most tragic and horrific incidents in the history of Black Friday shopping. His story is often remembered and retold as a cautionary tale of how materialism and consumerism can make people lose their humanity and compassion.

Many people are shocked and appalled that Damour’s family only received $400,000 for his death, while Walmart made billions of dollars in sales that year. Over the past 15 years many people have called for a boycott of Walmart or a ban of Black Friday altogether, while others have urged shoppers to be more respectful and responsible when they go to stores.

Jdimytai Damour is also honored and commemorated by his family, friends, and community. He is buried at Plain Lawn Cemetery in Hicksville, New York, where his grave is marked by a simple headstone.

He is remembered as an easygoing, helpful, and poetic man who loved his family and had dreams of becoming a teacher.

His friend Ronald Jean Myrthil, claimed that on September 11, 2001 it was Jdimytai Damour that came to pick him up when he “staggered across the Brooklyn Bridge fleeing Manhattan”.

Damour was a Freeport High School graduate, and a first year student at Nassau Community College, and unfortunately now is also a tragic reminder of how blinded consumers become in the pursuit of material things on Black Friday.

On that day those Walmart customers who charged the door disregarded human life just to get some electronics they’ll want to replace in 3 years. Then allegedly complained when his body caused a delay in opening the store. Hence why many have dubbed them the “Most Evil Black Friday Shoppers Ever”.
