A California teenager has filed a lawsuit against 2K Games, the developer and publisher of the popular NBA 2K video game series, alleging that the company engages in unfair and illegal practices to make gamers spend real money on virtual currency (VC), and then wipes out their VC without any compensation or explanation.

According to Axios, the lawsuit filed by J.A., a minor, on behalf of himself and all others similarly situated. The court documents claim that 2K Games uses manipulative and deceptive marketing techniques to entice gamers, especially children, to invest real money in VC, which can be used to purchase various items and features in the game, such as player attributes, skills, outfits, and accessories.
The lawsuit also claims that despite offering no options to transfer VC, 2K Games arbitrarily shuts down the servers for older versions of the game, rendering the VC useless and forcing gamers to buy new versions of the game and more VC.
For example NBA 2K19, which was released in September 2018 and had its servers shut down in December 2020, less than two and a half years after its release. This is a much shorter lifespan than other gaming franchises, such as Call of Duty, which allow gamers to transfer their in-game currency to newer editions of the game.
The lawsuit, which was filed in the United States District Court for the Northern District of California under Case 3:23-cv-05961, allegedly seeks to recover the value of the VC that 2K Games has taken away from gamers, as well as injunctive relief to prevent 2K Games from continuing its alleged misconduct. The lawsuit allegedly also seeks to certify a class action, which could potentially include millions of gamers who have been affected by 2K Games’ VC practices.
The lawsuit seems to accuse 2K Games of violating several laws, including the California Consumer Legal Remedies Act, the California Unfair Competition Law, the California False Advertising Law, and the federal Magnuson-Moss Warranty Act. The lawsuit reads, in part:
“There is no justification for wiping out gamers’ VC. For years, other gaming franchises, such as Call of Duty, have carried over the equivalent of VC into new editions of the game, allowing users of newer versions to use in-game currency collected in older versions. There is no technological limitation or business justification for wiping out players’ VC, and 2K Games offers no explanation for doing so” .
It continues:
“2K Games’ conduct described herein is unfair, illegal, and greedy. After bombarding gamers, including child gamers, with manipulative marketing designed to entice them to invest real money in VC under the pretense of ownership, it needlessly wipes out the VC they acquired to drive them to buy more VC in a new game setting. Plaintiff brings this action to enjoin this misconduct and reclaim the value of the VC 2K Games has wrongfully taken away” .
